BlueChip Financial d/b/a Spotloan (“Spotloan”) operates this Site to provide general financial information, information about Spotloan, and facilitate the services provided by Spotloan. Spotloan is a brand owned by BlueChip Financial, a wholly owned economic arm and instrumentality of the Turtle Mountain Band of Chippewa Indians of North Dakota, in the United States of America (“Tribe”), a federally recognized Indian Tribe. Spotloan is organized and governed by the laws of the Tribe, and is located on and operates within the Tribe’s reservation in North Dakota. As used throughout the Terms of Use, the term “Services” shall mean the online loan products offered by Spotloan. Spotloan offers its Services directly to borrowers through desktop or mobile devices through its website. As used throughout the Terms of Use, the Term “Site” shall mean both Spotloan’s website, www.spotloan.com, and BlueChip Financial’s website, www.bluechipfinancial.com.

We make no representation that materials on this Site are appropriate or available for use in other locations. Spotloan’s Services may not be available to residents of all states.

Your use of the Site warrants that you will not use it for any purpose that is unlawful or prohibited by these Terms of Use. Although Spotloan attempts to ensure the accuracy and integrity of the information on the Site, it makes no representations, warranties, or guarantees as to the accuracy of the Site and its content.

The Terms of Use describes the terms and conditions of use of this Site by you, the website viewer, and your rights and responsibilities as a user. Spotloan hereby grants to you a limited, non-exclusive, non-transferable right to access this Site. In compliance with the Children’s Online Privacy Protection Act (“COPPA”), Spotloan does not knowingly collect or retain personally identifiable information (“PII”) from users under the age of thirteen (13). This Site and our Services are for users over the age of 18, subject to compliance with the Terms of Use and in accordance with applicable federal laws and the laws enacted by the Tribe. This Site is intended for use within the United States.

The contents of this Site, including without limitation, text, design, graphics, images, and other content (collectively, the “Content”) are owned by or licensed to Spotloan, its third party vendors, and/or other third parties. The Content is protected under copyright law. Your use of this Site provides limited access to view, download, and print the Content, solely in conjunction with your permitted use. No portion of this Site should otherwise be reproduced, stored, or transmitted by any means for any purpose. Such unauthorized use will constitute a violation of copyright, trademark, and other laws. Any copies of copyrighted or trademarked materials, or names obtained from this Site, should retain all copyright and proprietary notices and should not be used without permission. Permission to Gather and Verify Data

Spotloan does not collect and store PII from Site users; any PII collected and received from you through your loan application for our Services is submitted voluntarily by you. Spotloan is committed to the protection and security of your PII that you provide us or that we obtain about you from third parties with your consent. Spotloan has implemented administrative, technical, and physical safeguards to protect and secure your PII. You give Spotloan permission to verify the information you provided to us in your loan application for our Services. We may also use the information you provided to gather additional data related to your loan application for our Services. This information may come from a number of sources, including consumer reporting agencies and sources named in the loan application, and may be shared with our employees, affiliates, vendors, partners, and third parties as required to offer you a loan.

Important information about procedures for opening a new loan:

To help the government fight the funding of terrorism and money laundering activities, federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account with us for our Services. When you apply for a loan, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask for a copy of your driver’s license or other identifying documents, and we may use this information to verify your identity or other information you provide.

Collection and use of bank account information:

If we extend credit and provide our Services to you, we will consider the bank account information provided by you as eligible for us to process payments. In addition, as part of our information collection process, we may detect additional bank accounts under the ownership of you. We will consider these additional accounts to be part of the loan application process.

Credit reporting disclosure:

We may make inquiries concerning your credit history and standing to third parties such as credit reporting agencies, and may report information concerning your performance including, but not limited to, missed payments, or other defaults, to credit reporting agencies. Missed payments or other defaults on your loan may be reflected in your credit report.

Accuracy of your account information:

In keeping with reasonable industry standards, we have procedures to ensure that your financial information is accurate, current, and complete. If you believe our records contain inaccurate or incomplete information about you, please notify us. We will investigate your concerns and correct any information we determine to be inaccurate.

Contact and marketing preferences:

Spotloan may contact you by several methods, including but not limited to, electronic mail to any email address you provide, regular U.S. Postal mail to any address we have on file, calling you at any number you provide to us with an auto-dialer or pre-recorded message, and text messaging or via other mobile communications method, if you have provided your mobile telephone number to us. We may use one or all of these methods to contact you about your loan or application for our Services, inform you of promotions, savings, and/or services we believe may interest you, remind you of upcoming payments, and to communicate with you regarding collections and other loan-related issues.

It is your responsibility to keep your contract information up to date with Spotloan. If we are unable to reach you using the contact information we have, we may reach out to third-parties to obtain updated contact information for you. You authorize Spotloan and its authorized representatives to call you using a predictive dialer or other automated telephone dialing device during reasonable hours at any of the phone numbers you provide to us by pre-recorded message or live representative. However, you are not required to provide this authorization as a condition of entering into your loan. Certification and release:

By consenting to the Terms of Use, you certify that the information you provide to Spotloan is true, complete, and correct. You authorize Spotloan, its authorized representatives, servicers, and/or assignees to verify the information by contacting any of the persons or firms listed by you. You fully release all parties from claims of damage that may arise out of or relate to any such contacts. Any false information submitted by you shall be sufficient reason for denial of your request for our Services.

Limitations on Liability

Spotloan shall not be liable to any user of this Site for any damages whatsoever resulting from your use or inability to use this Site, its material, or any third party websites linked to this Site, including, but not limited to, direct, indirect, incidental, punitive, special, exemplary, or consequential damages (including, but not limited to, any lost profits, business interruption, lost savings, or loss of programs or other data), whether based on warranty, contract, tort, or any other legal theory, and whether we are advised of the possibility of such damages.

You agree that your sole remedy to any problem with this Site, including errors from and inaccuracies within, is to cease using this Site and the Services offered. Waiver and Severability

Any failure by Spotloan to enforce any right or provision of the Terms of Use shall not constitute a waiver of such rights or provisions. Should any competent court or arbitrator find any provision herein as invalid or unenforceable, that provision will be enforced to the maximum extent permissible and any and all other provisions of the Terms of Use will remain in full force and effect.

Jurisdiction and Choice of Law

You agree that the Terms of Use shall be governed by and construed in accordance with the laws of the Tribe, without giving effect to any principles of conflicts of law. You agree and understand that any loan agreement offered by Spotloan becomes a binding contract with us only when we accept it at our offices on the Turtle Mountain Indian Reservation. By entering into a loan agreement, you are availing yourself upon the jurisdiction of the Tribe and fully understand and consent that any loan agreement entered into is governed by United States federal law and the laws of the Tribe.
